Terms & Conditions
These Affiliate Program Terms and Conditions (“Agreement”) govern participation in the Megan Bolton Acrobatics Affiliate Program (“Program”). By applying to or participating in the Program, you agree to comply with these terms.
1. About the Program
The Megan Bolton Acrobatics Affiliate Program allows approved affiliates to promote Megan Bolton Acrobatics online education products in exchange for commission on eligible sales generated through their unique affiliate links.
The Program is owned and operated by Megan Bolton Acrobatics (“MBA”, “we”, “us”, or “our”).
Participation in the Program does not create an employment, partnership, joint venture, or agency relationship.
2. Eligibility
Affiliates may include:

Individual coaches
-
Studio owners
-
Content creators
-
Current or former students
-
Parents and supporters
-
Industry professionals
Applicants must:
-
Be at least 18 years of age.
-
Provide accurate registration and payment information.
-
Operate in a manner consistent with the values of Megan Bolton Acrobatics.

Be approved by MBA before participating.
MBA reserves the right to approve or reject any application at its sole discretion.
3. Affiliate Categories and Commission Structure
Commission rates are determined by the affiliate category assigned by Megan Bolton Acrobatics.
Student Ambassador
Designed for students, athletes, parents, and supporters who wish to share Megan Bolton Acrobatics products with their community.
Commission: 10% of eligible sales.
Coach / Industry Affiliate
Designed for coaches, teachers, judges, and other industry professionals.
Commission: 15% of eligible sales.
Studio Partner
Designed for dance studios, gymnastics clubs, performing arts schools, and other organisations wishing to recommend Megan Bolton Acrobatics products to their students.
Commission: 20% of eligible sales.
MBA reserves the right to review, modify, or amend commission rates and affiliate categories at any time, provided affiliates receive a minimum of 30 days’ notice.
4. Commission Eligibility
A commission is earned when:

A customer purchases through the affiliate’s unique tracking link or approved discount code.

Payment has been successfully processed.
-
The purchase remains outside any applicable refund period.
Commission is not payable on:
-
Refunded purchases.
-
Chargebacks or disputed transactions.
-
Fraudulent purchases.
-
Purchases made by the affiliate for themselves unless specifically approved.
-
Complimentary products.
-
Bulk or custom studio agreements unless otherwise agreed in writing.
5. Tracking and Attribution
Affiliate sales are tracked through Kajabi’s affiliate system.
Sales will be attributed according to Kajabi’s tracking settings and cookie duration.
MBA is not responsible for:
-
Tracking failures caused by browser settings, ad blockers, device changes, or customer actions.

Lost commissions resulting from incorrect links or affiliate error.
The records maintained by MBA and Kajabi will be considered final.
6. Payments
Affiliate commissions will:
-
Be calculated monthly.
-
Be paid only after the applicable refund period has expired.
-
Be paid via the payment method nominated by the affiliate.
A minimum balance of AUD $50 must be reached before payment is issued. Balances below this amount will roll over to the following month.
Affiliates are responsible for providing accurate payment details.
MBA is not responsible for delayed payments resulting from incorrect payment information.
7. Refunds and Adjustments
If a customer receives a refund, the corresponding commission will:

Be deducted from future commissions; or
-
Be reversed if already paid.
If an account shows excessive refunds, suspicious activity, or abuse, MBA may suspend or terminate the affiliate account.
8. Promotional Guidelines
Affiliates agree to represent Megan Bolton Acrobatics professionally, ethically, and honestly.
Affiliates must:
✔ Promote products honestly and accurately.
✔ Clearly disclose affiliate relationships where legally required.
✔ Comply with Australian Consumer Law and all applicable advertising laws.
✔ Use approved branding materials where provided.
Affiliates must not:
✘ Make false, misleading, or exaggerated claims.
✘ Guarantee specific results or outcomes.
✘ Misrepresent themselves as employees or official representatives of MBA.
✘ Engage in deceptive marketing practices.
✘ Engage in spam or unsolicited messaging.
✘ Bid on “Megan Bolton Acrobatics”, “MBA Online”, or similar branded terms in paid advertising without written approval.
✘ Use misleading discount offers or create unauthorised coupons.
Examples of prohibited claims include:

“This course guarantees an aerial.”

“You will definitely master your skill in 8 weeks.”

“Megan Bolton personally coaches every student.”
9. Brand and Intellectual Property
All Megan Bolton Acrobatics content, logos, videos, manuals, graphics, trademarks, educational materials, and other intellectual property remain the exclusive property of Megan Bolton Acrobatics.
Affiliates may only use marketing materials provided or approved by MBA.
Affiliates may not:

Reproduce, modify, or distribute course content.

Share purchased course materials publicly.
-
Upload MBA content to websites, social media platforms, or file-sharing services.
-
Use MBA branding in a manner that implies ownership, partnership, or official representation.
10. Social Media and Public Conduct
Affiliates are expected to conduct themselves professionally and in a manner consistent with the values of Megan Bolton Acrobatics.
MBA reserves the right to suspend or terminate participation if an affiliate:

Engages in bullying, harassment, discrimination, or abusive conduct.

Damages the reputation of MBA.
-
Makes defamatory statements about MBA, its staff, or students.
-
Acts in a manner inconsistent with child safety, coaching ethics, or professional standards.
11. Confidential Information
Affiliates may receive confidential information including:

Upcoming product launches
-
Pricing strategies
-
Marketing campaigns
-
Internal business information
Affiliates agree not to disclose confidential information without written permission from MBA.
12. Termination
Either party may terminate participation in the Program at any time.
MBA may immediately terminate an affiliate account if the affiliate:

Breaches these Terms and Conditions.
-
Engages in fraudulent activity.
-
Violates intellectual property rights.
-
Misrepresents MBA or its products.
-
Damages the reputation of MBA.
Upon termination:
-
Affiliate links will be deactivated.
-
Unpaid commissions associated with fraudulent or non-compliant activity may be forfeited.
-
Legitimately earned commissions may still be paid at MBA’s discretion.
13. Limitation of Liability
MBA makes no guarantee regarding affiliate earnings.
Affiliate income depends on numerous factors, including audience size, marketing effort, and market conditions.
To the fullest extent permitted by law, MBA shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in the Program.
14. Modification of Terms
MBA reserves the right to amend these Terms and Conditions at any time.
Affiliates will be notified of significant changes via email or through the affiliate platform.
Continued participation in the Program following such changes constitutes acceptance of the revised Terms and Conditions.
15. Governing Law
These Terms and Conditions are governed by the laws of the State of New South Wales, Australia.
Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.
